What the Arbitration is all about?

Arbitration- at its core, it is a legal term for dispute resolution outside the court. In other words, it is a private, and judicial settlement of a dispute by a third party, known as “Arbitrator”. With the benefits of flexibility, confidentiality, and prospects of enforcement, arbitration has emerged as an effective method of resolving business disputes. It has its own rules and regulations mentioned under Arbitration and Conciliation Act 1996 (Act), which is based on the Act is based on the 1985 UNCITRAL Model Law on International Commercial Arbitration and the UNCITRAL Arbitration Rules 1976

Principles:

A consensual procedure: Arbitration can only be carried out if both parties are agreed. As it is a legal procedure, it can be included in the relevant contract. A party cannot withdraw from arbitration in any case.

The parties choose the arbitrator: All the parties mutually select an arbitrator.

Arbitration is unbiased: Parties can choose the elements like applicable law, language, as well as venue of the arbitration.

Arbitration is a confidential activity: A high degree of confidentiality is maintained throughout the procedure.

The decision of the arbitrator is final: The parties have to obey the decision of the arbitrator without any further confusion.
